Employment Law

Employment Discrimination
Several federal and state statutes bar employers from discriminating or retaliating against an employee because of his or her race, gender, age, national origin, religion, marital status, disability or actions as a whistleblower, and the law further protects employees from sexual harassment. At the Law Office of Brandon J. Gibson, PLLC we have a passion for protecting the rights of employees and those of small businesses that have been accused of discrimination retaliation or harassment.

Wage & Hour Disputes
The Fair Labor Standards Act (“FLSA”) establishes minimum wage, overtime pay and recordkeeping requirements affecting employees in the private sector and in federal, state, and local governments. In Florida, covered nonexempt workers are entitled to a minimum wage of not less than $8.05 per hour.  Overtime pay at a rate not less than one and one-half times the regular rate of pay is required after 40 hours of work in a workweek.  The Law Office of Brandon J. Gibson, PLLC represents people whose employers have denied their rights under the FLSA, as well as small businesses accused of improperly paying their employees.
